Terms and Conditions for Listing Your Property with Indocasa Properties

 

  • The Seller confirms to be the legal representative of the property located at the address provided in the listing form completed by the Seller.

  • The Seller agrees to provide Indocasa Properties with copies of the ownership certificate(s) and any other documents relevant to the property’s legal status. These documents must be valid and up to date. The Seller affirms that the original documents are available at all times for establishing a binding agreement or preparing the official deed required by the notary.

  • The Seller confirms that, if a property transaction is mutually agreed upon by a client introduced by Indocasa Properties, the transaction can be executed at any time using the original documentation, at a legal office agreed by both parties.

  • If Indocasa Properties introduces a buyer who is willing and able to purchase the property, but the sale cannot be completed due to missing or invalid legal documents, the Seller agrees to pay a fee of 1.5% of the agreed sales price to Indocasa Properties. We strongly recommend that the Seller arrange for legal due diligence by an independent notary prior to listing the property.

  • The Seller agrees to immediately inform Indocasa Properties of any changes in the asking price of the property.

  • The Seller agrees to refer any interested parties, who learned of the property through Indocasa Properties’ marketing efforts, back to the agency.

  • It is strictly prohibited to exchange personal contact information (such as email addresses, phone numbers, or business cards) with potential clients introduced by Indocasa Properties during property viewings. Similarly, Sellers are not allowed to accept such information from clients during inspections.

  • The property will be listed on the website: www.indocasa-properties.com.

Sales Price and Commission

  • The Seller will indicate the desired sales price in the listing form and agrees that this price includes a 5% commission for Indocasa Properties.

  • The agreed market price includes the 5% agent commission. If the final sales price is reduced through negotiation, the agent’s fee remains 5% of the final agreed price.

  • The commission will be deducted from the first down payment received by the notary appointed by the buyer. If the down payment is made directly to the Seller, the Seller agrees to pay the 5% commission to Indocasa Properties within two (2) days of receiving the payment.

  • Taxes such as sales and purchase taxes, as well as contract-related costs (e.g., notary fees), will be borne by the parties signing the contract, according to applicable laws.

  • If a buyer introduced by Indocasa Properties cancels the transaction and forfeits the deposit, 50% of the forfeited amount will be retained by Indocasa Properties and 50% will be paid to the Seller.

  • By positively answering the final question in the property listing form on www.indocasa-properties.com, the Seller agrees to these terms and conditions.

Please note:

This is a non-exclusive agreement. The Seller is free to sell the property independently or in cooperation with another agent. In such cases, the Seller is not obligated to pay any commission to Indocasa Properties.

 

Important Note:

Please have copies of all legal documents—such as land certificates, building permits, land and building tax receipts, lease agreements, and/or nominee contracts—ready for review when our intake team visits the property.
